1. About these terms

These terms apply to shopironbarkhome.com (“Ironbark Home”, “we”, “us”) and to every order placed through it. By placing an order you agree to them. If you do not agree, please do not order.

Ironbark Home is operated from the State of Georgia, United States. You can reach us at hello@shopironbarkhome.com.

2. Eligibility

You must be at least 18 years old, and able to enter a binding contract, to place an order. By ordering you confirm that you are.

3. Orders and acceptance

Placing an order is an offer to buy, not a completed sale. A contract is formed only when we send a shipping confirmation. Until then we may decline or cancel an order — for example if an item is unavailable, if a price or description was wrong, or if we suspect fraud. If we cancel an order you have already paid for, we refund it in full.

4. Pricing and errors

Prices are in US dollars and may change without notice. We take care to price and describe items accurately, but errors happen. If we discover an error affecting your order, we will contact you and give you the choice of continuing at the correct price or cancelling for a full refund. We will never charge you more than the price you were shown without your agreement.

5. Payment

Payment is taken at checkout through Shopify's payment processing. We do not see, store, or handle your full card details.

6. Product descriptions, colour and measurement

We describe our products as accurately as we can, including their limitations. Materials, care instructions, dimensions and country of origin come from the manufacturer. Colours vary between screens and under different lighting, and fabric measurements can vary slightly between production runs. If an exact shade or dimension matters to you, email us before ordering and we will tell you what we know.

7. Shipping, delivery and risk

Shipping is governed by our Shipping policy, which forms part of these terms. Delivery windows are estimates, not guarantees. Risk of loss passes to you on delivery to the address you provided.

8. Returns and refunds

Returns are governed by our Refund policy, which forms part of these terms. Nothing in these terms limits any rights you have under applicable consumer protection law.

9. Acceptable use

Please do not use this site to break the law, infringe anyone's rights, introduce malicious code, scrape or harvest data, or interfere with the site's operation or security.

10. Intellectual property

The Ironbark Home name, our written content, and our page designs belong to us and may not be copied or reused without permission. Product photography supplied by our manufacturers remains theirs and is used with permission.

11. Third-party links and services

This site relies on third-party services, including Shopify for hosting and payments and carriers for delivery, and may link to sites we do not control. We are not responsible for the content or practices of third-party sites.

12. Disclaimer and limitation of liability

The site is provided “as is”. To the fullest extent permitted by law, we exclude implied warranties, and our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.

14. Privacy

Our Privacy policy explains what personal information we collect and how we use it, and forms part of these terms.

15. Changes to these terms

We may update these terms. The version in force is the one published on this page when you place your order.

16. Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws rules. The courts of that state have jurisdiction over any dispute, and nothing here affects consumer rights you may have where you live.
